EU court OKs resale of software licenses
(AP:LUXEMBOURG) The EU's top court says software makers cannot prevent people who download programs from selling their licenses to other users as long as they disable their own copies.
The ruling Tuesday, in a case brought by California-based software maker Oracle against UsedSoft, a German company that resells software licenses, could have broad implications for the digital industry.
The Court of Justice ruled Oracle cannot stop people from selling the right to use a program as long as they stop using it themselves. That makes downloaded software legally similar to a program on CD or even a book.
The owner of a CD or a book cannot make copies and sell them while keeping the original. But, having bought it, he or she can legally sell the original CD or book.
